1.Acceptance

You may use the site for lawful personal, noncommercial informational purposes. You may not impersonate Eldhurst, remove notices, introduce malicious code, bypass security controls, interfere with the site, or use access methods that create an unreasonable burden or violate law.

6.No warranties

7.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELDHURST LLC AND ITS MEMBERS, MANAGERS, AFFILIATES, AND SERVICE PROVIDERS WILL HAVE NO LIABILITY FOR ANY CLAIM, LOSS, OR DAMAGE ARISING FROM THE SITE, ITS CONTENT, ITS AVAILABILITY, OR RELIANCE ON IT. THIS EXCLUSION INCLUDES DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, AND CONSEQUENTIAL DAMAGES, LOST PROFITS, AND LOST DATA.

If applicable law does not allow liability to be excluded, their aggregate liability for claims arising from the site will not exceed $100. These limitations do not restrict rights or remedies that applicable law makes nonwaivable.

8.Indemnification

To the extent permitted by law, you agree to reimburse Eldhurst LLC for reasonable third-party claims, losses, and costs caused by your unlawful use of the site, malicious interference with it, or material violation of these Terms. This section does not require a consumer to indemnify Eldhurst LLC for its own conduct and does not waive nonwaivable consumer rights.

9.Governing law and changes

Massachusetts law governs these Terms, without regard to conflict-of-law principles, except where mandatory law requires otherwise. We may update these Terms by posting a revised effective date. Continued use after an update means you accept the revised Terms.
